By clicking [“I AGREE”], you and the entity on behalf of whom you are using the WhatCollege Platform (“you” or “Recruiter” or “Counsellor” as applicable) are entering into an agreement with FirstPoint International Ltd t/as WhatCollege (“WhatCollege”, “us”, “we”, “our”, “FirstPoint USA”) , under which you will be bound by the terms and conditions (the “Terms and Conditions”). See full Terms and Conditions. If you do not agree to be bound by the Terms and Conditions, you will not be permitted to access or use the WhatCollege Platform (as defined in the Terms and Conditions). Capitalised terms not otherwise defined here have the meaning set out in the Terms and Conditions.
While it is your responsibility to review the Terms and Conditions carefully, the following is a summary of certain key terms of the Terms and Conditions:
Commission. The Commission paid to you will be shown on the dashboard of the WhatCollege Platform and due to exchange rates and other factors could end up being higher or lower than the estimate shown on the dashboard. Additional provisions regarding the Commission you will be paid are located in Section 12 of the full Terms and Conditions.
Student Consent. Recruiters are responsible for obtaining the signed personal information consents from Students to allow Recruiter to share information with the WhatCollege Partners and WhatCollege and authorising the Recruiter or WhatCollege to engage with the WhatCollege Partners on behalf of the Students. Additional details are located in Section 4 of the full Terms and Conditions.
Non-Solicitation and Non-Competition. During the Term and for 18 months after these Terms and Conditions are terminated or expire, in the countries in which the Recruiter have performed the Recruitment Services, Recruiter must not create a platform to compete with
WhatCollege or solicit any WhatCollege Partner to use products or services that directly compete with the WhatCollege Services, without prior written consent from WhatCollege. Additional details are located in Section 17 of the full Terms and Conditions.
Confidentiality. Recruiter must keep the terms of these Terms and Conditions, Recruiter application form and all information provided by WhatCollege confidential. Additional confidentiality obligations are located in Section 16 of the Terms and Conditions.
Limitation of Liability. In our recruitment partner relationship, we will generally not have any liability to you. Our maximum liability to you, if any, will not exceed £2,000 GBP. Additional details are located in Section 24 of the Terms and Conditions.
Changes to Terms and Conditions. Except where prohibited by applicable law, we may change the Terms and Conditions at any time by posting a new version to the WhatCollege Platform. You are responsible for monitoring the WhatCollege Platform for any such changes
and for reviewing such changes. Additional details are located in Section 2 of the full Terms and Conditions.
Privacy. By providing us with any required registration and/or personal information, Recruiter agree that we may perform verification and screening services and will hold your information in accordance with our privacy policy (found at https://www.whatcollege.com/privacy-policy) and data governance practices as a data controller. Additional details are located in Section 10 of the full Terms and Conditions.
Term: Subject to early termination or expiry of this Agreement the initial term of this Agreement will be 12 months from the date that Recruiter agrees to this Agreement and will automatically renew for subsequent 12-month terms on the anniversary of this Agreement.
